Public Offer Agreement for Software Access

1. General Provisions and Offer Acceptance

This document constitutes an official public offer by Sole Proprietorship (FOP) Bobych Lesia Ihorivna (hereinafter — the "Contractor" or "Licensor") to enter into an Agreement for licensed access to "Jyotish Helper" cloud software with any legally competent individual or entity (hereinafter — the "User").

Acceptance (full and unconditional agreement) of these terms occurs upon paying for a software subscription, registering an account, or actively using any module of the service.

This Agreement has full legal force as an electronic agreement pursuant to the Law of Ukraine "On Electronic Commerce" and the Civil Code of Ukraine.

2. Scope of Agreement, Terms and Procedure of Service Provision

The Contractor provides the User with paid, limited, non-exclusive access to "Jyotish Helper" cloud calculation software under the SaaS (Software as a Service) model for performing mathematical, astrometric calculations and celestial coordinate cycle modeling.

Service terms: Services are delivered strictly in electronic format via the web platform interface. All calculations, coordinate grids (D1-D30), Panchanga intervals, and Paryaya cycle modules run algorithmically on open astronomical ephemeris catalogs and serve academic, educational, and analytical purposes ("AS IS"). The software does not provide medical, legal, financial, or investment advice.

Procedure of service provision: To obtain access, the User selects a subscription tier and duration, authenticates in the system, and completes full advance payment via the integrated payment gateway.

Terms of provision: Access to the chosen software capabilities is provided continuously throughout the paid period (30, 90, or 365 calendar days). The platform operates on a 24/7/365 schedule, excluding brief scheduled server maintenance windows.

3. Terms and Methods of Delivery

Nature of delivery: Delivery of the software product is conducted exclusively in electronic digital format over the Internet. Physical delivery of tangible media, courier delivery, or postal shipment is not provided and does not take place.

Activation timeframe (electronic delivery): Full access to the software modules in the User's personal account is unlocked automatically in real time within 1–5 minutes following transaction confirmation by the banking gateway.

Fulfillment of obligations: The service is deemed rendered by the Contractor and digital delivery executed in full upon opening access to the relevant subscription functionality in the User's workspace.

4. Payment Methods and Settlement Terms

Payment is made on a 100% advance payment basis in cashless form in the national currency of Ukraine — Hryvnia (UAH).

Accepted payment methods on the website: Visa and Mastercard payment cards (issued by Ukrainian and international banks), as well as contactless digital payment methods Apple Pay and Google Pay through a certified payment gateway.

Recurring billing: Subscribing involves consent to recurring automatic charges every 30 days (or the chosen period) to provide uninterrupted access. The User may cancel auto-renewal in their personal account at any time without fees.

5. Intellectual Property Rights

All exclusive property rights to the source code, web interface, calculation algorithms, and database structures of the "Jyotish Helper" platform belong to the Contractor.

The User receives an end-user personal license solely to use the interface during the paid subscription term. Decompilation, unauthorized code copying, or automated scraping is prohibited.

6. Warranty Disclaimer and Limitation of Liability

The software is provided on an "AS IS" basis. The Contractor does not warrant uninterrupted server availability or absence of local hardware/browser incompatibilities on the User side.

The Contractor shall under no circumstances be liable for indirect damages, lost profits, or decisions made by the User based on algorithmic calculations.

The Contractor's maximum total aggregate liability across any claims is limited to the cost of one month of the User's active subscription.
